Scope
These terms apply to open courses, in-company training, advice and related services by Van Goubergen P&M under the Lean Academy name.
Registration and confirmation
A registration becomes final after confirmation by Lean Academy. Practical information, location, dates and any preparation are communicated in advance. Van Goubergen P&M reserves the right to refuse candidates for its open training programmes where, for example, they carry out competing activities or belong to a competing organisation.
Invoicing and payment
Our standard rates are based on a payment term of 30 days from the invoice date, in accordance with the Belgian Act of 22 November 2013 amending the Act of 2 August 2002 on combating late payment in commercial transactions and European Directive 2011/7/EU. If a payment term of 60 days or 30 days end of month (EOM) is agreed in writing in advance, the total invoiced amount will be increased by 2% to compensate for the additional financing provided by us. For 90 days from the invoice date or 60 days EOM, the increase is 4%. In the absence of prior written agreement, the standard 30-day term applies. For commercial transactions between enterprises, late or partial payment of an invoice will, by operation of law and without prior notice of default, result in contractual damages equal to 10% of the outstanding amount for administration and extrajudicial collection, together with interest at 12% per annum. This does not exclude additional reasonable recovery costs. Where mandatory consumer-protection rules apply, those rules prevail and charges will only be applied to the extent permitted by law.
Cancellation and changes
In case of too few participants, force majeure or practical necessity, Lean Academy may move or reschedule a course. Participant cancellation is handled according to the terms that apply at registration.
Intellectual property
All intellectual property rights in our course materials and exercise cases are reserved. Any use, including partial use, requires the prior written agreement of Van Goubergen P&M.
Personal data and privacy
Van Goubergen P&M processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Belgian data-protection law.
